Privacy Policy

Persisto.fit is operated by Matthys Benson, trading as MJB Strategic ("we", "us", "our"), based in the Republic of South Africa.

This Privacy Policy explains what personal information Persisto.fit collects, why we collect it, how we use it, who we share it with, where it is stored, how long we keep it, and the rights available to you.

It applies to everyone who uses the Persisto.fit website or app, wherever in the world you are.

We have written this policy in plain language. If anything is unclear, contact us at showup@persisto.fit and we will explain it properly.

What information we collect

When you create an account and use Persisto.fit, we collect the following information.

• Account information: we collect your email address. If you sign in with Google, we receive the basic profile details Google shares with us, which are your name and email address.
• Training information: we collect the training information you choose to enter into Persisto.fit, including session types, exercises, sets, repetitions, weights, distances, routines, weight logs, and goals and targets you set. This information is the core of what Persisto.fit does, and it is information you choose to enter into the app. Some of it may be capable of revealing information about your physical condition, fitness, body measurements or health; we do not collect medical records or ask for a medical diagnosis as part of normal use.
• Basic technical information: our hosting providers keep standard server logs associated with requests to the service, which may include an IP address and a timestamp. We use this only to keep the service secure and running, never to build an advertising profile of you.
• Feedback you send us: if you use the Feedback feature in the app, we store the message you write, together with your account, so that we can read it and reply to you. Please do not include sensitive personal details in a feedback message. Feedback is deleted when you delete your account.
• Marketplace activity: if you add exercises or workouts from the Marketplace, we record which creator's content is in your library. We use this to work out how a share of subscription revenue is divided between creators. Creators only ever see their own totals, never who you are.

We do not run advertising, and we do not use third-party analytics or tracking tools at this time. If this changes, we will update this policy before introducing the new processing.

Why we collect and use your information

We will not use your information for a new purpose that is incompatible with the purposes described in this policy without providing the information or obtaining the consent that applicable law requires.

• To create and secure your account and allow you to sign in.
• To store and display your own training information, which is the purpose of the app.
• To operate, maintain and improve Persisto.fit, including diagnosing technical problems.
• To bill your subscription, once Persisto.fit is available to buy, through the app store's own billing system.
• To email you service messages about your account, such as a reminder before your free trial ends.
• To respond when you contact us for support.
• To maintain the security and reliability of the service.

Information you are required to provide

An email address is required to create and use a Persisto.fit account.

The training information described in this policy is information you choose to enter into the service. If you choose not to enter particular training information, Persisto.fit will not be able to provide the corresponding tracking functionality.

Where additional information is required for a particular feature, we will explain this at the point where it is collected.

Who we share your information with

We use a small number of service providers to operate Persisto.fit. We share information with them only to the extent reasonably necessary for them to provide their services to us.

• RevenueCat, our subscription-management provider, which processes information relating to your purchase and subscription status through the app store's billing system so that Persisto.fit can determine whether your account has an active subscription.
• Supabase, our database and authentication provider, which stores your account and training data on servers located in the European Union, specifically Frankfurt, Germany.
• Vercel, our hosting provider, which serves the Persisto.fit website and app.
• Sentry, our error-reporting provider (servers in Germany), which receives technical details when the app crashes or hits an error, such as the error message, the page, and basic device and browser information, so that we can find and fix problems.
• Namecheap (Private Email), which delivers the emails we send you, such as your sign-up confirmation and a reminder before your free trial ends.
• Google, if you choose to sign in with a Google account.
• The app store from which you download Persisto.fit, which processes your subscription payment once Persisto.fit is available to buy.

We do not sell your personal information, and we do not share your training data with anyone else for their own independent purposes. Each provider is contractually restricted to using your information only to provide its service to us.

International transfers

Your account and training data are stored with Supabase in the European Union. Some providers we rely on, including Vercel and Google, may process information in other countries as part of how their infrastructure operates.

Where information is transferred to or made accessible from another country, we handle the transfer in line with the data-protection requirements that apply to us, including applicable rules on international transfers. For EU and UK users, an international transfer can require a specific legal mechanism, such as an adequacy decision or appropriate contractual safeguards, depending on the destination.

How we protect your information

All connections to Persisto.fit are encrypted using HTTPS.

Inside the database, each account's data is separated using row-level security rules, so that one account cannot read or change another account's training data, even in the event of an application bug.

No online service can guarantee that information will never be subject to unauthorised access, loss or misuse. Where applicable law requires us to notify you or a regulator about a security incident, we will do so.

How long we keep your information

We keep your account and training data for as long as your account is active.

If you ask us to delete your account, we permanently delete your account and training data, other than information we are required to keep for a short period to satisfy tax, billing or fraud-prevention obligations.

Your privacy rights

Wherever you live, you can contact us at showup@persisto.fit to ask us to:

• provide a copy of the personal information we hold about you
• correct information that is inaccurate
• delete your account and personal information
• restrict how we use your information
• object to certain processing of your information
• where applicable, provide your personal information in a portable format

The availability and precise scope of these rights depends on the law that applies to your circumstances. If we process your information on the basis of your consent, you may withdraw that consent at any time; this does not affect processing that was lawful before you withdrew it. We may need to verify your identity before completing certain requests, to prevent someone else from obtaining or changing your information.

Complaints

If you believe we have handled your personal information improperly, please contact us first at showup@persisto.fit so we can investigate.

If you are in South Africa, you may also complain to the Information Regulator of South Africa. If you are in the European Union, you may complain to the data-protection supervisory authority in your EU member state. If you are in the United Kingdom, you may complain to the Information Commissioner's Office (ICO).

Cookies

Persisto.fit uses only the cookies needed to keep you signed in securely. We do not use advertising or analytics cookies. If this changes, we will update this policy and, where required, obtain consent before using non-essential cookies or similar technologies.

Children

Persisto.fit is not directed at children. We do not knowingly collect information from anyone under the age of 16. If you believe a child has created an account, contact us at showup@persisto.fit and we will take appropriate steps, including deleting the account and associated information where required.

Automated decision-making

Persisto.fit does not currently use your personal information to make decisions about you that have legal or similarly significant effects through solely automated decision-making, and we do not use your information to create an advertising profile of you. If this changes, we will update this policy and provide any information or rights required by applicable law before introducing the relevant processing.

Changes to this policy

We may update this Privacy Policy when our data practices, service providers, technology or legal obligations change. If we make a material change, we will update the date at the top of this page and, where appropriate, let you know directly.
