Terms of Service

These terms are a contract between you and Matthys Johannes Benson, trading as MJB Strategic ("we", "us", "our"), based in the Republic of South Africa, covering your use of Persisto.fit (the "service"). By creating an account or using Persisto.fit, you agree to these terms. If you do not agree, please do not use the service.

What Persisto.fit is

Persisto.fit is a personal gym and progress-tracking tool. It lets you record workout sessions, exercises, weight and other training data, and view your own progress over time.

Who can use it

You must be at least 16 years old to create a Persisto.fit account. If you are under the age of legal majority where you live, you confirm that a parent or guardian has agreed to these terms on your behalf.

Your account

• You are responsible for keeping your login details secure.
• You are responsible for the accuracy of the training data you enter.
• One account is for one person; please do not share accounts.
• You may stop using Persisto.fit, or ask us to delete your account, at any time (see our account deletion page).

Subscriptions, free trials and billing

Persisto.fit is offered through mobile app stores as a subscription with a free trial period. During the trial, you are not charged. Unless you cancel before the trial ends, the subscription automatically renews and you are charged the subscription price through the app store you subscribed via, on a recurring basis, until you cancel.

• Billing, receipts and cancellation are all handled through that app store, not directly by us.
• You can cancel at any time from your app store's subscription settings; cancelling stops future charges, and your access continues until the end of the period you already paid for.
• If we change the subscription price, we will give you notice before it applies to you, in line with that app store's requirements.

Health and fitness disclaimer

Persisto.fit is a tracking and record-keeping tool. It is not a medical device, and it does not provide medical, health or professional fitness advice. Any score, target, projection or suggestion shown in the app is calculated from the data you entered and is for your own informational use only.

Speak to a doctor before starting any new exercise programme, especially if you have an existing health condition. You are solely responsible for your own safety while training, and for judging what is appropriate for your own body and circumstances.

Acceptable use

You agree not to:

• use Persisto.fit for anything unlawful;
• try to access another person's account or data without permission;
• attempt to reverse-engineer, scrape or interfere with the service; or
• use the service in a way that could damage, disable or overburden it.

Ownership

We own Persisto.fit's software, design and branding. You own the training data you enter; we only store and process it to provide the service to you, as described in our Privacy Policy.

Ending your access

You may stop using Persisto.fit at any time. We may suspend or end an account that breaches these terms, misuses the service, or where required by law, and we will make reasonable efforts to tell you why.

No warranty, limitation of liability

Persisto.fit is provided "as is". We do our best to keep it running reliably and your data safe, but we do not promise the service will always be available, uninterrupted or error-free. To the maximum extent permitted by South African law, we are not liable for indirect losses arising from your use of the service, including any injury arising from your own training decisions.

Governing law

These terms are governed by the laws of the Republic of South Africa, and any dispute will be subject to the jurisdiction of the South African courts, regardless of where you access Persisto.fit from.

Changes to these terms

We may update these terms from time to time. If we make a material change, we will update the date at the top of this page and, where appropriate, let you know directly. Continuing to use Persisto.fit after a change takes effect means you accept the updated terms.
